When your accident has been completely or partially caused by a government entity or one of its employees, the rules completely change. Government defendants can get their own rules for who can sue them and when. Whether you’re pursuing a claim against your city, the state of Nebraska, or the federal government, there can be hurdles to clear and strict guidelines to follow.

Time limits for filing a claim

If you want to file a claim against the federal government, the state of Nebraska, the city, or county you believe to be at fault, you will have to do so within a certain time limit. Although some states only allow claims to be made within 30 days after the accident, Nebraska allows two years. On a county, city, and school district level, injured parties instead have one year to file a claim.
If you miss the deadline, your case may not be completely washed up. If you didn’t realize at the time that a government entity could be to blame, you may be able to file a late claim if you can present good reason for the delay. Missed deadlines should never be the reason not to file a claim, even if late filing does make the process more difficult for injured parties.

State or Federal
Tort Claims Act

Suing the federal government is much different than suing a private citizen. If you have an injury claim against the following you may be able to sue under the Federal Tort Claims Act.

R
FBI agent
R
Veterans Administration doctor
R
Post office
R
Any federal entity or employee

Who is Liable?

In order to sue the government, it must be determined that specific errors and flaws alone led to an injury. Because most roads are maintained by the state (or a lower level agency), lawsuits must navigate the STCA.

Hiring a Government Negligence Lawyer

Suing the government is much more complicated than suing a private citizen. Hiring an injury attorney can make certain that requirements are met and rules are followed. An attorney can sort through the details of a case and offer insight as to whether to file a claim, who to sue, and how much compensation to expect.
